Chapter 1 General Provision Welcome to EPIK(English program in Korea) community site run by the NIIED (National Istitute for International Education) for the enhanced exchange of ideas about teaching English and friendship between EPIK. Article 1. (Purpose) The purpose of this Terms of Use is to specify the terms and conditions for the use of EPIK community (hereinafter referred to as the ¡°Site¡±) provided by the National Institute for International Education (hereinafter referred to as the "NIIED"). Article 2. (Effectiveness and Change in Terms of Service) (1) The Terms of Use is effective when posted on the Website menu.(2) NIIED may change the terms and conditions when the change is reasonably needed, and in such case, NIIED will post the change of terms and conditions on the Notice Board without delay.(3) The user who disagrees with the change may terminate the membership. The user who continues to use the Website after the Terms of Use is effective may be regarded to agree with the change. Article 3. (Other Regulations) Any provisions which are not specified in this Terms of Use will be interpreted and applied in accordance with the related regulations or general conventions. Article 4. (Definition) The following terms shall have the following meanings respectively. User (or Member):a person or company who entered the service contract with NIIED ID:a combination of letters or numerals made by User and approved by NIIED for the identification of User and use of services. Password:a combination of letters or numerals created by the User for security of membership information. TerminalAn instrument used by User for using the services of the Website, such as a personal computer and modem. Use of Website User¡¯s use of information provided by NIIED through a terminal connected to the host computer of NIIED. Internet sitesSites of electronic mailing, forwarding files, remote site login, and webs, provided through the connections with worldwide computer networks. Service contractThe contract between User and NIIED for using the Website according to the Terms of Use. Chapter 2 Entering Service Contract Article 5. (Effectiveness of Service Contract) (1) The Terms of Use apply to you when you click the "Agree" button in the registraration process(2) The Service contract will be effective when NIIED approves the User's registration. Article 6. (Registration) (1) Applicants may apply for use of the Website by online submission of registration forms specified by NIIED. (2) All the information of the registration forms submitted by applicants is regarded to be true. In the event that an applicant's information is not true, the applicant may no be protected by law and the use of the Website may be restricted. Conditions for registration(3) Membership in the Service is void where prohibited. This Site is intended solely for users who are currently EPIK - applicable to to both native and Korean who have served as EPIK. Any registration by use of or access to the Site by anyone who is not or has not been a EPIK is unauthorized, unlicensed and in violation of these Terms of Use. By using the Service or the Site, you represent and warrant that you are currently a EPIK - either a native or Korean scholar - or Alumni scholar who has served as a EPIK before. You agree to and to abide by all of the terms and conditions of this Agreement. Article 7. (Reserving Approval) (1) NIIED may reserve approval of the service contract in the following cases:In case of a shortage of NIIED's capacity; In case of a technical problemOther cases that are considered necessary for effective management of the Website by NIIED. (2) NIIED may not approve the registration in the following cases:In case that an applicant applies for use of the Website by using of other person¡¯s name;In case that the information of registration forms is not true;In case that an applicant submits registration for the purpose of destruction of the order of society or of public morals and manners. Article 8. (Change in Content) In case of any change in the user information items, the User may renew the content . The User shall assume responsibility for the problems that may arise when the items are not changed into the updated text Chapter 3. Use of Website Article 9. (Service Hour) The service shall be provided to the User 24 hours a day (00:00-24:00) for 365 days. Service may be discontinued temporarily, such as for routine maintenance managed by NIIED. Article 10. (User's Obligation) (1) The User shall be totally responsible for maintaining his/her own ID and password.(2) The User shall not share, hand over, or change his/her own ID without valid reasons.(3) The User shall be responsible for any results occurred by using the ID and Password or by the illegal using of the third party.(4) The User shall provide accurate, current and complete information about him as may be prompted by any registration forms on the Site (5) The User shall maintain and promptly update the Registration Data, and any other information to provide to NIIED, to keep it accurate, current and complete;(6) The User shall be fully responsible for all use of his (her) account and for any actions that take place using his (her) account. Article 11. (Restriction of Using Website and Termination of Service Contract) (1) The User shall apply for termination through online measures to NIIED when the User is willing to terminate the service contract.(2) NIIED may terminate the service contract or restrict the use of Website in part or overall when the User is in the following cases: In case the User uses other User¡¯s ID;In case the User transmits excessive data to inhibit the stable management of the Website;In case the User forwards transmits information such as advertisements to others contrary to their intentions;In case the User spreads computer viruses to lead to the failure of instrument or the destruction of information;In case the User is the subject to be restricted in the use by the Information Communication Ethics Committee;In case the User performs election campaign defined illegally by the Election Management Committee;In case the User uses the data of the Website for commercial purposes without NIIED's previous consentIn case the User violates the related regulations on telecommunicationOther cases that NIIED decides to be inappropriate (3) The specific cases by which the User is restricted in the use of Website and the kinds and duration of the restriction shall be notified on the Notice Board or Guidance. Article 12. (Deletion of Posting Information or Restriction on Use of Website) (1) In case of a shortage of the facility's capacity related to the service, NIIED may delete any information posted or registered by the User if necessary. (2) In case of a shortage of the facility's capacity related to the service, NIIED may restrict the use of Website by the User in part or overall if necessary.(3) In case of ¨ç and ¨è, NIIED shall previously notify the Users with it through online.(4) NIIED may delete the information posted by the User on the Website without prior notification in the following cases: In case the information defames or insults other User or the third party;In case the information includes the content, sentence, or diagram that may be against the public morals and mannersIn case that the information may be related with anti-national, anti-social, or criminal activities; In case that the information infringes the rights of other Users or the third party, such as intellectual property rightsIn case that the duration of posting the information exceeds the regulated time;Other cases that may violate the related laws and regulations. Article 13. (Suspension or Restriction of Providing Website) (1) NIIED may suspend providing the Website in the following cases:In case of inevitable repair or construction of the facilityIn case that the common carrier determined by the Telecommunications Business Act suspends the telecommunications website.(2) NIIED may suspend or restrict providing the Website due to a national emergency, a failure in the facility, or an interference with the use of the Website by the congestion, etc. Article 14. (NIIED's Obligation) (1) NIIED shall maintain the facility for the Website available for stable provision of the site and shall repair or recover the facility in case of a problem.(2) NIIED shall post a notification on the Website if there is a change or addition in the contents of the Website. Article 14-1. (Protection of Personal Information) (1) According to the related regulations including the Act on Promotion of Information and Communication Network Utilization and information Protection, etc., NIIED shall protect the personal information provided by the User in the registration and later and created during the use of the site.(2) The User¡¯s provision of his/her personal information to NIIED through forwarding shall be considered that the User permits NIIED to collect and use the information. The purpose of the collection and use of personal information is: To implement the service contract including the provision of the Website;To create marketing data and guide the UsersTo mail or forward advertisements(3) NIIED shall provide the User¡¯s personal information to the third party without the User¡¯s previous agreement only in the following cases:In case that an investigation organization requires the personal information in written statement for investigative purpose;In case there is a specific provision in regulations such as the Use and Protection of Credit Information Act or Act on TelecommunicationsIn case there is a need of such information in statistics, academic investigation, or market research and specific individual cannot be verified when the information is provided.(4) The User may read his/her own personal information at any time, and may correct an error in the information. The process of the reading and correcting is the same with the one of the registration in principle. Detailed process shall be notified on the Notice board or Guidance. (5) The User may cancel the consent on the collection and use of his/her personal information, the separate consent on the additional purposes, and the separate consent on the provision of the information to the third party by terminating the service contract at any time. The method of termination shall be defined separately in the Terms of Use. Article 15. (The User¡¯s Obligation) (1) The User shall not be supposed: To use illegally the ID of other User's;To use of information of the Website for duplication, publication, broadcast, or supply to the third party without NIIED's previous consent;To defame or insult other User or the third party;To spread the content, sentence, or diagram that may be against the public morals and manners to the others;To perform activities related with anti-national, anti-social, or criminal activities;To infringe the rights of other Users or the third party, such as intellectual property rights;To do any other activities that may violate the related laws and regulations.(2) The User shall observe the provisions of his Terms of Use, the guidelines, and attention posted to the Website.(3) The User shall install terminals suitable for the regulations on the telecommunication technical specifications, and the terminals shall not disturb the operation of the Website. Chapter 4. Copyright Article 16. (1) All content on the Site and available through the Service, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the "Site Content"), are the proprietary property of the NIIED, its users or its licensors with all rights reserved. (2) No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the NIIED's prior written permission, except that the foregoing does not apply to your own User Content (as defined below) that you legally post on the Site. (3) Provided that you are eligible for use of the Site, you are granted a limited license to access and use the Site and the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. (4) Except for your own User Content, you may not upload or republish Site Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited. Such license is subject to these Terms of Use and does not permit use of any data mining, robots, scraping or similar data gathering or extraction methods. (5) Any use of the Site or the Site Content other than as specifically authorized herein, without the prior written permission of NIIED, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws.(6) Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time without notice and with or without cause.(7) You understand that the Service and the Site are available for your personal, non-commercial use only. You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory or otherwise unlawful material.(8) In addition, you agree not to use the Service or the Site to: harvest or collect email addresses or other contact information of other users from the Service or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;use the Service or the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site;use automated scripts to collect information from or otherwise interact with the Service or the Site;upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable; upload, post, transmit, share, store or otherwise make available any videos other than those of a personal nature that: (i) are of you or your friends, (ii) are taken by you or your friends, or (iii) are original art or animation created by you or your friends;register for more than one User account, register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity; upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; upload, post, transmit, share, store or otherwise make publicly available on the Site any private information of any third party, including, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers;solicit personal information from anyonepersonally identifying information for commercial or unlawful purposes;upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of Company, is objectionable or which restricts or inhibits any other person from using or enjoying the Site, or which may expose Company or its users to any harm or liability of any type.(9) You are solely responsible for the photos, profile information given, messages, notes, text, information, music, video, listings, and other content that you upload, publish or display (hereinafter, "post") on or through the Service or the Site, or transmit to or share with other users (collectively the "User Content"). (10) You may not post, transmit, or share User Content on the Site or Service that you did not create or that you do not have permission to post. You understand and agree that the NIIED may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that in the sole judgment of the NIIED violates this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating backup copies and replacing any User Content you post or store on the Site or provide to the Company.(11) When you post User Content to the Site, you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the User Content on the Site. By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the NIIED an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorize sublicenses of the foregoing. (12) You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that NIIED may retain archived copies of your User Content. NIIED does not assert any ownership over your User Content; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content. Chapter 5. On Administrative Appeal and Indemnification Article 17. On Administrative Appeal The User shall not submit administrative appeal or public petition on any problem arising from the use of the Websites provided by NIIED. Article 18. Indemnification Members agree to indemnify and hold NIIED and related organizations harmless from problems due to or arising out of members¡¯ use of the websites managed by NIIED. NIIED shall not assume any responsibility for the above-mentioned problems. Appendix(Enforcement Date) This Terms of Service shall be executed from January 1, 2009. All personal information managed by the National Institute for International Education (hereinafter referred to as NIIED) is collected, possessed, and used with the consent of its members based on the Terms of Use provided on the website of the TaLK Community site. The Act on the Protection of Personal Information Maintained by Public Agencies, the Enforcement Ordinance, and the Enforcement Regulations of the Act defined general rules on the management of personal information, and NIIED will manage the information collected, possessed, and used on the basis of the rules in order to execute public service and to protect the rights and interests of people. The basic policy of NIIED on the protection of personal information is as follows: Protection of Personal Information on the TaLK community site The personal information of TaLK scholars will be used only for inner operation for managing the website, implementation of the TaLK program, to perform regular general duties of TaLK office under NIIED, such as sending brochures and similar materials, or send information and webzine regarding TaLK program. Personal Information Required in Sign Up The personal information entered when you register is for the use of the services provided by the website of the TaLK community site will be used only for internal purposes for the management of the website The basic information required in signing up includes your name, residence, immigration month, User ID, password, and POE When you use the website of the Center, the following information is automatically collected and saved: - The IP Address of the terminal that you use. - Date of your visit, etc. The information collected automatically will be used in the statistical analysis for improving and complementing the site and the active communication between the users and the website administrators in order to provide you better services. However, if the governmental organization requires the personal information according to the related regulations, the information may be provided. Security Measures In order to secure the website and to provide stable services, NIIED will take appropriate measures to prevent leakage, loss or damage of personal information such as monitoring the network traffic and running various programs for detecting illegal attempts of changing information. Although NIIED is making every effort for the security of the website, please do not upload personal information that may cause problems in case there is a possibility to infringe your privacy. Collection of Other Members' Personal Information on Website You shall not collect other members' identifiable personal information such as email address on the websites managed by NIIED. Those who browse or are offered such information on purpose or by illegal methods may be punished according to the related regulations.
